48329951 home Double Vicarious Liability in St. Williams Group ActionThe Supreme Court have reversed the Court of Appeal decision by holding that not only the distant managers but also the brotherhood who “employed” the abusive priests are to blame.

Judges said the De La Salle Brotherhood was liable along with the Middlesbrough diocese which owned the school.

The BBC puts it thus -

“A Catholic teaching institute is liable for alleged physical and sexual abuse at a former boys’ school, the Supreme Court has ruled.

Claims of abuse are being made by 170 former pupils of St William’s in Market Weighton, East Yorkshire.

Judges said the De La Salle Brotherhood was liable along with the Middlesbrough diocese which owned the school.

The BBC’s Danny Shaw said it was a landmark ruling which could affect other claims of abuse at institutions.”

The Claimants were represented by our own Executive Officer David Greenwood.

This case has been going on since 2001. David will no doubt be relieved that settlements can hopefully be offered by the Church.
